I\'m planning to start new consultancy services which provides cctv operators to MNC companies. I have to design pay slip for my employees. Please help me out on procedure to open ESI account, Criteria to be met for ESI contribution, If basic salary = 6500, Then is ESI mandatory? If basic salary < 6500, Then is ESI mandatory? If basic salary > 6500, Then is ESI mandatory? Let me know, When ESI is mandatory and when ESI is optional?

yes ESI is mendatory, any organisation have more than 10 employees have to registed in ESi. only those employees are not under coverage of ESI whose salary is more than 15000 & employees have more than 6500 amount can be exempted from PF only.
you can apply onlline for ESI registration or can hire a consultant also.

We have one clarification with regards to the maternity benefit act, member has to work 80 days to avail the Maternity leaves of 12 weeks but what is the criteria to avail the miss carriage leave will the same logic will holds good for miss carriage leave also.

In case of Miscarriage , the befinifit for a period of 6 weeks following the date of miscarriage.will be given to woman.

ESI is mandatory if the employee is having salary of less than or equal to 21000 and the establishment has 10 or more workers.
However, while counting workers only permanent employees count, not hourly/daily wage contract workers. Also till now the whole country is not covered by esi act. Only those areas notified by govt of India (ministry of Labour) is covered. The areas notified is a dynamic list and progressively newer areas are added. You can check with the esi website or nearest esi office to know if your particular area is covered.
Also, if i may add, esi service provides important health / disability / unemployment insurance. Denial of esi facility by eligible employers is not only illegal but also immoral.
